1. CALL TO ORDER

Supervisor Arthur P. Willman called the special meeting to order at 6:30 PM. The Pledge of Allegiance was recited, the Town Clerk called the roll, introduced guests, and declared a quorum was present.

2. PURPOSE OF SPECIAL MEETING: Mr. Willman announced the purpose of the special meeting was to open, review and award the bid for the Vermontville Garage repair of soffit, fascia and insulation. The bids received:

B. MERRILLSVILLE GARAGE REPAIR - LABOR ONLY Supv. Willman stated that Doug Snickles' bid was the lowest and the Town had worked with him on other projects and found it to be satisfactory. Coun. Hamm reported that as Doug and his partner were now incorporated, the reason for his low bid was that he would be doing the work himself, without having to rely on employees who were paid "prevailing wage." The roof could be reshingled or replaced by metal; consensus among the Board was that the color of the roof should be brown, to match the structure.

The bids were discussed, and consensus was that D&D Carpentry had submitted the lowest bid; therefore, Supv. Willman requested a motion for a resolution awarding the bid to D&D. Motion (B.Merrill-D.Hamm m/s/p) ALL AYE

RESOLUTION NO. 50: AWARD BID FOR VERMONTVILLE GARAGE SOFFIT, FASCIA REPAIR TO D&D CARPENTRY WHEREAS, requests for bids were published for repair of the Town Garage soffit, fascia, and insulation on the north side of the edifice; and WHEREAS, on July 18, 2012 at a special meeting of the Town Board three bid submissions were opened and reviewed; and WHEREAS, D&D Carpentry, co-owners Douglas Snickles and Dan Martin, Vermontville, submitted the lowest bid ($15,050) for materials & labor; NOW, THEREFORE, BE IT RESOLVED, the Town Board hereby awards the contract for Town Garage (Vermontville) repair of soffit, fascia and insulation to D&D Carpentry.

3. NEW BUSINESS

A. OPEN DEDICATED SAVINGS ACCOUNTS. Supv. Willman recommended, after consultation with the Budget Officer, establishing special savings accounts for (1) a Cemetery Improvement Reserve Fund and (2) a Rec Park Reserve Improvement Fund. In this way, individuals can donate money to these projects without concern that the funds will be used for anything but capital improvements and not general maintenance. Any money deposited in these accounts can only be used for capital improvements and may not be transferred out to cover any other cost. The Clerk reported that thus far in 2012, the Town received over $300 in donations from people who have used the Rec Park and for continued improvements to the cemeteries. RESOLUTION NO. 51: AUTHORIZE ESTABLISHMENT OF SPECIAL RESERVE SAVINGS ACCOUNT FOR RECREATION PARK CAPITAL IMPROVEMENTS WHEREAS, the Town of Franklin has a lovely recreation park for which the Town Board contemplates major improvements, including enlarging the playing fields areas and at some time in the future, building a community center; and WHEREAS, the Board considers setting aside funds generated from tax revenue as well as contributions by individuals best set aside in a special savings account; NOW, THEREFORE, BE IT RESOLVED, the Supervisor is authorized to open a special reserve savings account for the capital improvements at Kate Mountain Recreation Park with Community Bank, Saranac Lake.

Supv. Willman then requested a resolution for a Cemetery Special Reserve Savings account for capital improvements. Motion (C.Smalley-B.Merrill m/s/p) ALL AYE.

RESOLUTION NO. 52: AUTHORIZE ESTABLISHMENT OF SPECIAL RESERVE SAVINGS ACCOUNT FOR CEMETERIES CAPITAL IMPROVEMENTS WHEREAS, the Town of Franklin is responsible for three well-maintained cemeteries; and WHEREAS, the Town contemplates improvements, including creation of circular drives, and gridding and marking plots; and WHEREAS the Board considers setting aside funds generated from tax revenue as well as contributions from individuals best set aside in a special savings account; NOW, THEREFORE, BE IT RESOLVED, the Supervisor is authorized to open a special reserve savings account for capital improvements to the Town Cemeteries.

B. PUBLISH RFP FOR 13 TONS OF ROAD SAND. Supv. Willman reported that Highway Superintendent Jacques DeMars requested a RFP be published for up to 13 tons of screened road sand for this coming winter. Coun. Berg asked how much sand remained from last winter, and Coun. Hamm replied there may be more than 3 tons left. Motion (B.Merrill-D.Hamm m/s/p) ALL AYE.

RESOLUTION NO. 53: PUBLISH RFP FOR WINTER ROAD SAND WHEREAS, requests for bids for road sand and fuel must be published for the coming year; NOW, THEREFORE, BE IT RESOLVED, the Town Board authorizes the publication of a requests for bids for up to 13 tons of screened road sand, as follows: "PUBLIC NOTICE TO BIDDERS PLEASE TAKE NOTICE that the Town of Franklin is accepting bids on the purchase of up to 13,000 tons of screened road sand to NY State specs. Please provide price for sand picked up. Bids must be returned by 6:00 PM on Wednesday, August 8, 2012, and be accompanied by a non-collusive bidding certificate. Send bids to: Sandra J. Oliver, Franklin Town Clerk, P O Box 209, Vermontville, NY 12989 or delivered to same at the Town Hall, 7 Cold Brook Rd., Vermontville. Envelopes must be marked "SAND BID." Bids will be opened and awarded at a meeting of the Town Board at 7:00 PM on August 8, 2012 at the Town Hall, Vermontville, NY. The Board reserves the right to reject any or all bids. By Order of the Town Board; Sandra J. Oliver, Town Clerk."

C. TELEPHONE SYSTEM. Following the 17-hour power outage on July 17, 2012, all the programming in the Town’s telephone system failed and repair of the system will be performed on Monday, July 24, 2012. The Town no longer has a maintenance agreement with Tech II, Saratoga Springs, so the cost will be 4.5 hrs travel at $75 per hour plus $115 per hour for repair time. The system was purchased in 2001 and should be replaced or upgraded. Supv. Willman indicated replacement of the system would need to wait until 2013, and Coun. Hamm recommended publishing an RFP and perhaps financing for a new system could be arranged with a local supplier. Motion (D.Hamm-C.Smalley m/s/p) ALL AYE.

RESOLUTION NO. 54: PUBLISH RFP FOR NEW TELEPHONE SYSTEM WHEREAS, the telephone system at the Franklin Town Hall is aging and in need of repair; and WHEREAS, the supplier is not local and expense is incurred for travel time for repairs; NOW, THEREFORE, BE IT RESOLVED, the Clerk is authorized to publish a request for price in the Adirondack Daily Enterprise and Press-Republican for a new telephone system.

4. OLD BUSINESS

A. TOWN HALL GENERATOR UPDATE. Supv. Willman reported HomEnergy has indicated all of its work will be completed by this Friday. Next week North Country Electric will complete its part of the installation and test the unit.

B. MERRILLSVILLE GARAGE REPAIR UPDATE. The materials have been ordered, and work will commence soon. Supv. Willman will notify the two individuals who park their semi’s at the site. Coun. Hamm suggested contacting Overhead Door, Plattsburgh to confirm its installation of the overhead door.

C. FEMA-FUNDED REPAIR OF COUNTY ROUTE 26. Supv. Willman reported the NYS Dept. Environmental Conservation is insisting the Franklin County Highway Superintendent obtain a permit for repair of this road as it winds through forest preserve land. In the meantime $73,000 of FEMA funds and repair work is being held up. Coun. Merrill maintained the County has a right-of-way on either side of the route it owns, whether it is forest preserve or not.

D. TOWN HALL BILLBOARD. Half the letters on the billboard outside the Town Hall were blown off during the July 17th thunderstorm. He suggested installing a 1/4" sheet of plexiglass to cover the billboard at an estimated cost of $435. Coun. Merrill opined 2 sheets of 1/8" Luon affixed at the sides of the sign would be sufficient. Supervisor Willman will continue researching this.

5. IMPORTANT DATES

The Food Pantry is scheduled to be held on Thursday July 19th.
Saturday July 21st – work day at new fields at Rec Park
August 3rd will be the next date the mobile dental clinic is in Vermontville.
August 18th – Music Festival

6. ADJOURNMENT
