CALL TO ORDER
Supervisor Willman called the meeting to order at 5:30pm. The Pledge of Allegiance was recited and the Town Clerk called the roll noting a quorum present was present.

HIGHWAY SUPERINTENDENT'S REPORT
Superintendent DeMars reported the following:
- Plow and sanded when needed.
- Had the grader out a few times taking the buildup off.
- 284 for general repairs.
- Picked up garbage at intersection of Swinyer Rd. and Oregon Plains road. Also picked up old couch on Oregon Plains road.
- The illegal dumping of garbage has been an ongoing problem for some time. Not only does it become a health hazard but also a burden to the taxpayers when we have to remove it.
- Note: Since we will be getting rid of the 2006 Dodge (Unit #6) and the new Ford 350 did not have a unit number assigned to it, it will now be known as Unit #6.
- Change over from ’16 to ’17 ongoing(yearly folders). Gave Dick Meager totals for gas and fuel used in 2016.(General fund used 1,214.7 gals.)
- Completed paper work for PESH injury reports.
- Gas, fuel and maintenance logs given to Highway Committee
RESOLUTION #7 AGREEMENT FOR THE EXPENDITURE OF HIGHWAY MONEYS
On a motion by Councilman Woodcock, second by Councilman Hamm, BE IT RESOLVED that the Town of Franklin Town Board does hereby authorize the expenditure of Highway Funds up to $91,466 to be set aside for expenditures regarding primary work and general repairs upon 67.95 miles of Town of Franklin highways, including sluices, culverts and, bridges having a span of less than five feet and boardwalks or renewals thereof. ALL AYE
CODE OFFICER'S REPORT
One building permit and twelve Certificates of Occupancy were issued. Fourteen inspections were performed and fees collected were $280.00.
NEW BUSINESS
A. RESOLUTION #8 PROPERTY SEARCH FEE
Whereas, the Town of Franklin Town Board wishes to conform with all applicable Federal, State and other legal requirements, and
Whereas, the Town of Franklin wishes to comply with all uniform operating standards,
Now Therefore Be It Resolved, that the Town Board of the Town of Franklin approves of a fee being imposed upon Abstract Companies (and similar businesses) of $100 for property history searches.
Be It Further Resolved, that this fee will not be imposed upon individuals. The fee shall be collected by the Town of Franklin Code Enforcement Officer and processed by the Town of Franklin Town Clerk.

B. Quit Claim Deed
Supervisor Willman explained the Town has been contacted by an attorney representing a resident in Loon Lake, Karen Fardelmann. According to APA regulations, Ms. Fardelmann requires some additional footage of property (approximately .2 acres) to make improvements to her property. Ms. Fardelmann has requested the Town agree to a quit claim deed to allow her to annex this land to her current property. According to the Town Clerk, Assessor, Attorney for the Town Ed Murphy and Franklin County Real Property Mapping Department the is no record the Town of Franklin owns the property in question and further more, there is no record that the property has a tax map ID number therefore the Town has no interest in or claim to the property.
RESOLUTION #9 AUTHORIZATION TO EXECUTE QUITCLAIM DEED
WHEREAS, Ms. Karen P. Fardelmann, a homeowner in Loon Lake in the Town of Franklin, has asked the Town to execute a Quitclaim Deed with respect to a parcel of real estate that is situated between her property and the Town right-of-way for Mensink Road (“the parcel”);
WHEREAS, Ms. Fardelmann wishes to rebuild the existing house on her property, but has insufficient space to comply with APA regulations regarding setback from the Lake, unless the Town Quitclaims the parcel to her;
WHEREAS, The parcel lies within an abandoned rail bed, does not have a tax identification number, and does not appear to have an owner of record;
WHEREAS, The parcel is approximately two-tenths (.2) acres, is not needed for any Town purpose, is of no apparent value to the Town, and what interest, if any, the Town has in it is unknown;
WHEREAS, Filing the Quitclaim Deed will add the parcel to the tax rolls and, along with Ms. Fardelmann’s planned improvements, will increase the assessment for her property, and raise additional revenues for the Town, Franklin County, and the Saranac Lake Central School District;
NOW, BE IT RESOLVED: The Town Board hereby authorizes the Town Supervisor to execute a Quitclaim Deed (without warranties), conveying, with nominal consideration, to Ms. Karen P. Fardelmann whatever interest the Town may have in the real estate between (1) Ms. Fardelmann’s existing property (referenced by Tax ID# 309.01-1-4) and (2) the eastern edge of the Town’s right-of-way for Mensink Road. In no event shall the Quitclaim Deed affect the Town’s right-of-way for Mensink Road.

DEC will be holding a Public Comment Session regarding the Unit Management Plan at the Town Hall on March 1, 6pm. The Bog Trail, Bigelow Rd and the trails at Kate Mt Park could be impacted by this plan. Interested residents are encouraged to attend.
